FRESNO, Calif. (KSEE/KGPE) - A man from Merced was indicted for allegedly using smartphones to both receive and distribute child pornography, the Department of Justice said.
Federal officials say 35-year-old Joel Damian Ortega of Merced was arrested on Wednesday following the two-count indictment, charging him with receipt and distribution of child pornography.
Ortega's indictment was unsealed following his arrest, according to the DOJ.
Federal prosecutors say that between Jan. 26 and July 7, Ortega allegedly used a Samsung Galaxy to receive and distribute at least one visual depiction of a child engaged in sexually explicit conduct. He also allegedly used an iPhone to receive at least one visual depiction of a minor engaged in sexually explicit conduct on April 2.
If convicted, the Department of Justice says that Ortega faces a maximum statutory penalty of up to 20 years in prison, with a mandatory minimum of five years in prison, and up to a $250,000 fine for each charge.
