Decisions on Constitutional Amendments 1, 2 to be released Tuesday

HONOLULU (KHON2) -- The fate of two constitutional amendments will be decided as Hawaii voters finish casting their votes on Tuesday at 7 p.m.

Constitutional Amendment 1 would remove outdated language that allows the legislature to have sole discretion on how marriage is defined (sex, race, ethnicity, etc...). At this point, the legislature wouldn't need to consider what the people of Hawaii wants. Voting yes on 1 will change this.

In 1998, the State Constitution defined marriage as between a man and a woman.
Fast forward to today, same-sex marriage is recognized nationally. Constitutional Amendment 1 would remove the outdated language to prevent discriminatory action and provide protections against any United States Supreme Court reversal of their decision.
Constitutional Amendment 2 aims to unify the appointment and confirmation process for district court judges, supreme court justices and circuit court judges.
The amendment calls for the automatic appointment of judges if the Senate accepts them within the timeframe of 30 days.
Currently, higher court judges are selected by the governor from a list of nominees, with Senate approval. The proposed amendment would make the process for district court judges the same.

Instead of the governor making the appointment, the chief justice would choose a judge from a list; and the Senate would approve the choice.
The goal of the amendment is to make the judge appointment process more consistent across all courts in Hawaii.
