Man accused in Lenexa double homicide appears before Johnson County judge

OLATHE, Kan. -- A Lenexa man now faces capital murder charges in the death of his wife and son.
Todd Donovan, 53, is being held on a $2 million bond. He’s accused in the deaths of Sheila and Tyler Donovan, over the weekend. A neighbor's dog was also killed.
“We will work very, very, hard with our crime lab and our police department to make sure that we get justice for all the victims in this case,” Johnson County District Attorney Steve Howe said.
Donovan made his first court appearance Monday in a Johnson County courtroom.

"We have two fatalities that are involved, and then we also have the cruelty to animals charge. Because of the serious nature of two first degree murder charges, we thought it was appropriate to get that kind of bond,” Howe said. "Because two individuals' lives were taken, it does make this eligible for a capital murder case. That's something that we don't take lightly and it’s something that will take a considerable period of time working with the Lenexa Police Department before we ultimately make that decision."
Howe, says Donovan’s case is ‘eligible’ for capital murder charges.
"We are prepared and ready to accept appointment on this case, if the court is inclined to do that at this time,” a representative with the Death Penalty Defense Unit said.
A group called the "Death Penalty Defense Unit" spoke up at Monday's first appearance, with hopes of representing Todd Donovan. The Judge allowed the unit has been provisionally appointed.
"As far as the appointment of counsel, we are the only option under state law,” a representative with the Death Penalty Defense Unit said Monday to the judge.
Friday night, Lenexa police responded to the report of an "armed disturbance" in the 7900 block of Hallet. Once they arrived, they heard multiple gunshots coming from the area of the residence.
"Before officers continued up to the house, they stopped, initiated conversation with this individual. At this point, set up a perimeter and began negotiating for that person to come out,” Danny Chavez, with Lenexa police said. "At that point, we still didn't feel comfortable making the decision to go into the home to try arrest him, based on the amount of gunfire that we already been exposed to earlier in the evening.”
Communication with the man lasted two hours, before it stopped.
Chavez says the department utilized technology to assess the situation, such as drone and robots.
Donovan was eventually taken into custody just before 2 a.m. Saturday.
Multiple firearms were recovered from the scene, along with two deceased individuals. The two victims were discovered when officers went to take Donovan into custody.
LPD says no officers fired any weapons. There’s also no known history of domestic violence with the suspect and his family, according to the Lenexa Police Department.

Donovan’s next appearance is set for November 13.
The DA’s Office says Donovan should be presumed innocent until proven guilty.
