PROVIDENCE, R.I. (WPRI) — Cross-examination of the victim in a sexual assault and child pornography case involving a Providence middle school teacher got underway Monday. The bail hearing for Joseph Gannon, 50, began last Tuesday. Gannon was charged with one count of first-degree sexual assault and one count of producing or transferring child pornography in September. Booking photo of Joseph Gannon. Gannon has been held without bail since his arraignment on Sep. 23. (No plea was entered at his arraignment, as is typical with felony charges in district court.) A judge once again did not allow cameras to record the proceedings, but allowed reporters to take notes. On Monday, the victim explained that she was a 15-year-old high school freshman when she and Gannon -- her former middle school science teacher -- allegedly began a sexual relationship that would last three years. She said after communicating over email and phone that summer, it wasn’t long before he started asking her sexually charged questions and they eventually made a plan to meet up. She said he picked her up from her Providence home and took her to his house in Warwick where they had sex. The victim explained that what began as meeting up a couple of times a month increased to meeting a couple of times per week, adding that Gannon drove her to and from each location. Gannon would pick her up near where she attended high school in Providence, according to the victim, and he would drive her to various parks, parking lots or a hotel to have sex. In court on Monday, the victim was shown what prosecutors said was a redacted still image from a video that she said Gannon had recorded of her engaging in sexual activity. She said she was 16 years old at the time. She also told prosecutors that Gannon purchased sexual toys for her prior to them meeting up to have sex, and also "gifted" her clothing and lingerie. The victim said she felt the gifts were given in an attempt to reward her. When she recounted several graphic encounters to the court, she told prosecutors that she was scared to tell Gannon about the times she felt uncomfortable, but would continue to meet up with him because he was still her "only outlet" to vent about trouble she was having at home. The victim previously testified that she was suffering from physical abuse by a family member. She said Gannon did not report the abuse or offer his help, but she leaned on him to vent about the situation. The victim said she was about 18 years old when she had a realization about the relationship. "This isn’t right," she recalled. She told the court that when she was 18, she asked Gannon to give her back all of the photos and videos he had taken of her, but he told her no "because they’re made for him." The victim said she wanted them back because she "was a child" in the images and videos, she no longer wanted him to have them, and she was also worried that he'd show them to other people. Earlier this month, police searched Gannon’s home and took four cell phones, four hard drives, a PC, an iPod and 13 iPads, three of which were labeled as Providence city property. Police also seized a safe that contained several documents, including Gannon's teaching certificate. The victim said she made the choice to report Gannon on Sept. 19, two years after the end of their relationship, because of her goal to become a social worker. (Gannon was arrested at Nathanael Greene Middle School one day after she went to police.) "I feel it wouldn’t be right for me to go into that profession if I didn’t do this," she said on Monday. "And, just the realization that he’s a bad person," she added. Gannon's defense attorney tried to establish that the relationship the victim had with the defendant when she was between the ages of 15 and 18 was not forced on her, and that Gannon never threatened physical violence if she didn't comply. The victim told Gannon's attorney that while Gannon never threatened her with violence, she felt forced "in a way" because of Gannon's disappointment if she wasn't interested in engaging in sexual acts with him. She reiterated that she continued to talk and meet up with him because he was someone she vented to. Cross-examination is scheduled to resume on Wednesday afternoon. Gannon was placed on paid administrative leave following his arrest, but on Oct. 16 was suspended without pay, according to Providence Public Schools spokesperson Jay G. Wegimont.
