(KRON) -- Rep. Eric Swalwell (D-Livermore) will file a defamatory claim against Alameda County District Attorney Pamela Price, his lawyers announced on Sunday. The Bay Area congressman who ran unsuccessfully for president in 2020 plans to file a government tort claim against Price in response to what his lawyers say are defamatory statements. Last month, Swalwell held a press conference in which he came out in support of the recall effort underway against Price. "In retaliation, Price responded with many untrue statements about Swalwell, including he was trying to oust Price to 'shield himself from unethical practices,'" said Swalwell's attorney, Joseph Goethals of Goethals & Stone, PC. Voters to decide recall of Alameda County DA Pamela Price Swalwell's attorney sent a letter to Price on Oct. 19 asking her to retract what they called "untrue statements" she released. In the letter, Swalwell's attorney accused Price of making "false and scurrilous" allegations about the congressman. Price, the attorney said, did not respond to Swalwell or comply with his request. "Pamela Price leaves me no choice but to file this claim against her for her deliberate and untrue statements," said Swalwell in a statement. "No one is above the law, especially the Alameda County District Attorney. Price may be trying to run out the clock to her likely recall, but her intimidating tactics and efforts to seek political retribution can not stand. I will not allow her to try to damage my personal and professional reputation." Among other things, Swalwell's attorney said Price had falsely claimed that he'd previously endorsed the death penalty and implied she had "insider's knowledge" of Swalwell engaging in "prosecutorial misconduct" when he was an assistant DA in Alameda County. KRON4.com reached out to Swalwell's attorney, Joseph Goethals and received the following statement: "We believe it’s critical to hold top law officials accountable for their statements. Pam Price has lost the trust of the voters and is failing the public by spreading malicious lies about elected officials. When she attacks them, she needs to be held accountable. The next step in this legal process will focus on addressing her defamation, as there is no basis for these malicious lies. This recall effort shows that the voters have lost faith in Pam Price’s ability to keep the public safe and her actions over the last few months shows she has a casual relationship with the truth, failing in her duty to uphold integrity.” KRON4.com has also reached out to DA Price's office for a response.
