OKLAHOMA CITY (KFOR) — The Oklahoma Medical Marijuana Authority released its emergency rules Tuesday, and it's causing some confusion for dispensary owners. One of the confusing pieces is related to House Bill 3361, which was signed this year by Governor Stitt. "The worry I have the most is going to be the quality and freshness of the product," said Shaun Branch, dispensary owner. However, June 1, 2025, the deli-style type display will look different thanks to HB 3361. "The bill other than that is the pre-packaged bill we've passed off this floor the last three years," said Representative T.J. Marti, R-Broken Arrow. The bill says medical marijuana will be sold in "pre-packaged form weighing not more than three ounces." Tuesday, the OMMA released its emergency rules for dispensary owners. It includes HB 3361, but also mentions only a few instances where dispensary staff can open the pre-packaged bags, which caused a debate on the house floor back in March. "When I brought up the fact that there was nothing in the bill prohibiting dispensaries from opening the packages once they arrived at the dispensary and then pouring them into deli-style containers, Representative Marti agreed," said Representative Mickey Dollens, R-Oklahoma City. Chronic wasting disease found in Cimarron Co., says ODWC "Specifically, there's nothing that says they can't do that, but there's nothing that gives them the ability to do that," said Rep. Marti on the house floor in March. While the bill doesn't specify if dispensaries can or cannot put them into deli-style containers, it does say OMMA is authorized to communicate rules regarding the packaging as it falls under the bill. The future of sales is now causing a dispensary owner to ask questions. "Are we going to be able to open the bag and show the product to the customer? Are we going to be able to give them a chance to smell the product they're actually purchasing," said Branch. Branch said pre-packaged products aren't the most ideal for consumers. "Customers a lot of the time want to see the deli style. They want to come in and see a selection. You know, if they're just ordering blind, it becomes difficult for them," said Branch. Regarding OMMA emergency rule updates that went into effect Oct. 29, 2024, there will be an opportunity for the public to voice concerns and share feedback as part of our permanent rulemaking process during the upcoming public comment period Nov. 15-dec. 17. Oklahoma Medical Marijuana Authority Again, this will not go into effect until June 1, 2025.
