The other driver was ejected from his car and died at the scene. When questioned, Nuñez told police he thought he fell asleep.
When they searched his truck, NMSP found pipes and burned aluminum foil, associated with drug use. After an officer noticed Nuñez showing signs of intoxication, they decided to question him again. Nuñez told them he stopped before the deadly crash.
Nuñez has pleaded not guilty to homicide by vehicle and DUI. He's currently out under the supervision of pretrial services. A trial date has not been set.
