Former Carroll County prosecutor will not testify in Delphi murders trial

DELPHI, Ind. -- Special Judge Fran Gull, who is currently presiding over the Delphi double murder trial, has denied a subpoena calling for a former Carroll County prosecutor to testify in court.
Allen’s defense — composed of attorneys Andrew Baldwin and Bradley Rozzi — filed a subpoena on Oct. 22 seeking to have Robert Ives testify in court. Ives responded by filing a motion to have Gull quash the subpoena.
According to previous reports, Ives' motion argued that he should not be required to provide testimony since charges were filed against Richard Allen more than five years after he stepped down as the prosecutor on Dec. 31, 2017.
The motion contended that he was not a fact witness and that the case was a "work product" and not a part of discovery.
Allen has been in custody since October 2022 when Indiana State Police announced his arrest for his alleged role in the murders of Abby Williams and Libby German near the Monon High Bridge in Delphi.
On Monday, the Delphi murders trial wrapped up day nine featuring testimony from ISP Lt. Jerry Holeman, who discussed his initial interview with Richard Allen. Another highlight involved Maj. Pat Cicero of the La Porte County Sheriff's Department as he shared his forensic observations of the crime scene.
