CHARLOTTE (QUEEN CITY NEWS) — Charges have been dismissed against a Charlotte daycare director who was charged earlier this year with child abuse after part of the school was shut down by the state over health and safety concerns. According to Mecklenburg County court documents, the case against Leslye Denise Torrence, who was charged with misdemeanor child abuse, was dismissed on Thursday, Oct. 24. Court records state insufficient evidence to warrant prosecution. Cellphone video released earlier this year showed several Charlotte daycare employees with several children loose inside a vehicle at a local park. 16-year-old charged after allegedly sneaking loaded gun into Andrews High School in High Point According to Mecklenburg County court records, "The State believes there is insufficient evidence to prove that Torrence knew or reasonably should have known of the actions taken by the other two employees involved in the park on the day in question." Torrence was previously accused of “transporting the victim(s) in a vehicle without a car seat or seatbelt and the rear driver’s side door left open while the vehicle was in motion,” according to the arrest warrant. CMPD’s police report states that six children, all 3 to 4 years old, were observed in a vehicle unattended at a public park/playground in the 2100 block of N. Davidson Street. The 2024 police report stated, “The caller said the subjects (children) were in the care of daycare workers and did not have proper car seats. The subjects also drove away in a reckless manner with children unsecured in the vehicle.” In late February, the N.C. Department of Health and Human Services informed Midwood Learning Academy that it had to close at the end of the day on Monday, Feb. 26. The department sent the business, 2519 Central Ave., the following message:  “On February 23, 2024, the Division of Child Development and Early Education received information related to the health and safety of children at Midwood Learning Academy. Based on information received, the Division has determined that emergency action is required to protect the health, safety, and welfare of children.”  According to NCDHHS, Midwood Learning Academy has two separate licenses and two separate street addresses. One of them is right next to the other. The location at 2519 was ordered to shut down after the Division of Child Development and Early Education received a complaint concerning the health and safety of the children there. The following transcript below further details the State's decision to dismiss the 2024 charges: All three defendants stated their usual routine relating to taking the children to the park is for Ms. Torrence to drop the children and two other employees off in the van, leave to make everyone lunch, and then return to pick everyone up when the other two employees notify her they are ready to leave the park. 24-year-old man shot, killed in Greensboro On this date, Ms. Torrence stated she dropped off the children and one employee at one part of the park, and the other employee drove a personal vehicle and met them at the park. The statement from Ms. Torrence is that she dropped them off at a different part of the park than what is shown in the obtained video evidence, and the two employees must have put the children in the personal vehicle and then drove to the other area of the park as is shown in said videos. Ms. Torrence is not seen any video footage, and there is no further evidence to indicate Ms. Torrence would or should have been aware of the other two employees' actions that day after she left the area. Additionally, during the investigation by DHHS, both ofthe other two employees were required to submit to a drug test relating to allegations ofmarijuana consumption; however, both returned negative results. Immediately upon learning ofthe facts of the incident, Ms. Torrence suspended the two other employees.
