MEMPHIS, Tenn. -- Two of the three officers federally convicted in Tyre Nichols' death filed motions for acquittal, but now, the government is stating its opposition. Earlier this month, the attorneys for Justin Smith and Tadarrius Bean filed motions for acquittal. Bean and Smith were both found guilty on October 3 of obstruction, but not guilty on three other charges they each faced. Two ex-officers file motions for acquittal after Tyre Nichols verdicts “There is absolutely no record evidence that supports an individual finding of Mr.Bean guilty of obstruction of justice,” stated the motion filed in U.S. District Court in the Western District of Tennessee. The federal government has officially opposed the motions for acquittal, stating that ample evidence during the trial established that the men provided false information and intentionally omitted information. Smith and Bean were released on bail as they await sentencing in January. Meanwhile, the only former officer in jail after being convicted wants to be let out. Demetrius Haley's attorney recently filed a motion to address his detention. On Thursday, the government responded, saying Haley was convicted of a crime of violence and they believe he should remain in custody until his sentencing in January. A judge still has to rule on the matters.
