EL PASO, Texas (KTSM) — The hearing scheduled for Oct. 31 on the Walmart mass shooting case will move forward after District Court Judge Sam Medrano denied the prosecution's request to delay it by at least a month at a hearing held Thursday afternoon, Oct. 24. Last week, the El Paso District Attorney's Office filed two motions seeking that Judge Medrano postpone the Oct. 31 hearing and that he unseals any motions made in ex parte, meaning that they were made without their knowledge.  Prosecutors seeking to delay to next scheduled Walmart hearing Judge Medrano did concede to unsealing four court orders that will be made public at some point on Thursday.  District Attorney Bill Hicks addressed the media after the hearing.  "(The Court) kind of partially granted our request. So we'll have to see what those orders say. Again, the very nature of those orders mean that we don't know what the contents of those orders are. So we'll have to review what those orders say and then review our options and move forward and continue to prepare for the 31st," Hicks said. Hicks wouldn't confirm whether they plan to appeal Judge Medrano's ruling.  One of the defense attorneys for capital murder suspect Patrick Crusius, Felix Valenzuela, briefly addressed the media right after Hicks, furthering his claims during Thursday's hearing that the district attorney has violated orders of the court, specifically the gag order.  "So, we just want to let you know that (Hicks addressing the media) is the exact example of a violation of the court order. The gag order. The court has instructed us not to speak to the media, not to talk about the case. And that's the first thing they do as soon as they leave the courtroom. That's all I have," Valenzuela said.  Crusius murdered 23 people on Aug. 3, 2019, when he opened fire at the Cielo Vista Walmart store in El Paso and wounded more than 20 others. He pleaded guilty to federal charges in July 2023 and was sentenced to 90 consecutive life terms. The state's case is seeking the death penalty for Crusius. The prosecution tried to argue that the ex parte communication between Judge Medrano and the defense of Walmart's mass shooter was done improperly. They also tried to make the case that the three recent rulings made in ex parte, could indicate that there are over 200 court filings which could have been made in such a manner. The defense responded to the prosecution's motions on Thursday by arguing that they were trying to get the court to ignore their "egregious misconduct." They listed extensive examples which they argued highlighted the prosecution's misconduct, and that they were conflating ex parte documents with what they said were sealed documents.  Christopher Morales, a family member of some of the victims who were shot and killed by Crusius, addressed the media after prosecutors and the defense. He said the focus should shift from Crusius to the victims.  "I want to shift the focus away from the (hearing), because what really matters are the victims," Morales said. "Keep all of the victims in your prayers because they are still hurting, and this trial is making it worse. You will be hearing more from me because we are here to honor the victims, and that’s what we're going to do all of 2025." Valenzuela said he joined the Victims First network, which will begin organizing events throughout next year to honor the victims.  Victims First is a "network of surviving victims of mass casualty crime and trusted supporters who have first-hand experiences of the problems and re-victimization that accompany these acts when there is a lack of coordinated effort and/or understanding of what survivors need.", according to their website.  You can learn more by visiting their website here.
