ALLEN COUNTY, Ind. (WANE) ---More juvenile gun charges are leading to more incarcerated young people. That means in Indiana these young people, 16 to18 years of age, will be charged with felony gun possession once a second charge is filed. If that juvenile were an adult, one sentencing option should they be convicted would be home detention instead of jail or prison. Home detention is what Allen County will now offer to young offenders, if he or she has a suitable home. A change in the gun law prompted this change. “We are seeing more juveniles get waived on gun possession. A second offense can send you to adult court. We’re anticipating seeing more of those going forward,” Mike McAlexander, Allen County Prosecutor and chair of the ACCC advisory board, said. The advisory board comprising the highest level of judicial officers, probation, parole, public defender and law enforcement approved the measure Thursday at its board meeting. "Presumably this is going to be situations where it's going to be a choice between home detention or sending them to (the department of corrections)," McAlexander said. The Indiana Department of Correction operates prisons for men, women and juveniles under the age of 18. Allen County has seen more juveniles with guns, a problem not much different than what's happening nationwide. An example is the teen party Oct. 19 on Manistee Drive that erupted in gunfire, causing one teen to lose his life. Nine others were shot, although none were in life threatening condition, according to Fort Wayne police. Juveniles accepted into home detention will be able to live in a home, as long as it is approved by the courts. Kim Churchward, ACCC executive director, said monitoring juveniles is a “major policy change for the agency. We’re not accustomed to dealing with parents.”
