SHIPSHEWANA, Ind. (WANE) Earlier this month the USDA shut down an animal attraction located north of Shipshewana in LaGrange County following an inspection of the facility. The 21-day suspension took effect on October 9 and expires on October 30. On Wednesday, a civil suit was filed against the Dutch Creek Farm Animal Park and its operator, Vernon D. Miller by the U.S. Department of Justice. Dutch Creek Animal Farm Park The suit alleges multiple violations of the Animal Welfare Act (AWA). The lawsuit notes that the AWA was enacted by Congress to "ensure that animals used for exhibition or held for sale are provided humane care and treatment." Dutch Creek Animal Farm Park features a variety of animals, including zebras, camels, foxes, deer, farm animals and others. Visitors can see the animals on foot, via a wagon, or from their car. The lawsuit estimates the park to have 399 animals that fall under the guidelines of the AWA. Since September 2023 the USDA has found numerous violations of the AWA during multiple inspections; totaling 90 in less than a year, many of which were repeat violations. The lawsuit makes the following claims: Miller’s ongoing practices have placed and are placing the health of animals in serious danger Miller has failed to provide adequate veterinary care Miller has failed to provide sanitary housing, food, and water conditions Miller has failed to provide safe and hospitable housing and living conditions Miller has exposed animals to psychologically distressing conditions Miller has railed to create and maintain complete and accurate records The lawsuit asks the court to grant relief by keeping Miller from violating the AWA in the future. As for Miller, he posted a sign at the park after it was closed stating, "Due to USDA overreach, we have been required to close our doors with no notice!" Visitors are asked to phone the inspector general to file a complaint about the closure.
