New Mexico man faces new charges in sexual assault case after conviction overturned

ALBUQUERQUE, N.M. (KRQE) – An 82-year-old man who had his conviction overturned after being found guilty of raping a young neighbor was charged again in the case. David Sarver pled not guilty to three counts of criminal sexual penetration of a minor on Wednesday afternoon.

According to court records, police said Sarver sexually assaulted a minor between 2017 and 2020. He was found guilty in May 2022, but the Bernalillo County Court of Appeals found the judge allowed testimony that alluded to Sarver committing crimes he wasn't charged with and overturned his conviction.
Sarver is still behind bars on the new charges. A trial date has not been set.
