A Denver Police Department sergeant has been charged with felony menacing after he allegedly aimed a gun at another driver during a road rage incident earlier this month. On Oct. 3, Commerce City police officers pulled over Sgt. Jason Brake and another man, who both said they were involved in a confrontation while driving on U.S. 2. The victim told police that Brake aimed a gun at him during an argument on the roadway. Brake — who responding officers said was off-duty but was wearing a Denver police polo shirt and hat, and had a pistol holstered on his belt — said the victim had done the same. Officers searched the victim’s car and the route the two vehicles had taken on the way from the incident near Quebec Parkway but did not locate a second firearm. The affidavit notes that the victim’s description of the firearm Brake allegedly pointed at him was consistent with the appearance of the Glock that Commerce City officers confiscated from Brake. Brake told officers that he never removed his gun from its holster and that he was “90% sure (the victim) pointed a gun … or a black object” at him as the two were trying to pass a large truck. Brake’s alleged victim told officers this was the moment Brake threatened him with the Glock pistol. Brake said he yelled “police, pull over” at the victim after this, and once the two pulled onto the shoulder and Brake exited his car, the man sped off again. When confronted with the fact that the victim described Brake’s gun as having a red-tinted optical sight, which the man wouldn’t have been able to see unless the gun had been unholstered, Brake told officers that “red tint is common knowledge for gun optics.” The affidavit notes that Brake would have known as a police officer not to have exited his car or continued to drive next to an armed suspect to take their picture, as Brake said he did, all before Brake connected with 911. Brake’s alleged victim told officers that “he thought Jason Brake was going to shoot him during the incident.” Brake was booked into the Adams County Detention Facility at 9:47 a.m. Friday on a $2,000 cash-surety bond, according to jail and court records.
