CHICOPEE, Mass. (WWLP) - A student at the College of Our Lady of the Elms has filed a federal lawsuit against the school, three members of its staff, and a former student, after she was allegedly sexually assaulted in an on-campus dorm last fall. Jury finds Springfield man guilty in child sexual assault case According to the lawsuit, which was filed Thursday at U.S. District Court in Springfield, the plaintiff was sexually assaulted by Cody McCann inside his dorm room in the Rose William building in October of 2023 when she was a first-year student at the school.  Following the alleged assault, the plaintiff learned that two other female students had made sexual assault allegations against McCann to the school. The lawsuit alleges McCann violated an anti-harassment contract three weeks after the assault.  The plaintiff said she called Public Safety to have McCann removed but her calls went unanswered. After that incident, Elms reportedly posted a picture of McCann on its Instagram page with his arm around a female student, wishing them a Happy New Year. Eventually, Elms notified McCann he was unable to further enroll in any classes at the college. Lawyers for the alleged victim said the defendants breached their duty to Plaintiff when, after becoming aware of the dangers posed by Defendant McCann, including his repeated sexual assaults, they failed to take any reasonable steps to prevent him from sexually assaulting others, or otherwise warning students to prevent this from happening to them. Five defendants are named in the lawsuit: Cody McCann, the College of Our Lady of the Elms, Dean of Students Teresa Winter, Vice President for Student Affairs Andrew Coston, and Director of Public Safety Director Pablo Madera. The college and its staff are accused of Title IX violations for sexual discrimination and negligence. McCann is accused of intentional infliction of emotional distress and assault and battery. The plaintiff is seeking a jury trial and damages. 22News has contacted the College of Our Lady of the Elms for a response but has not yet heard back.
