Judge rejects request for new trial for Baton Rouge mom found guilty in death of boy

BATON ROUGE, La. (BRPROUD) -- A Baton Rouge mom convicted of second-degree murder in the overdose death of her young son is set to be sentenced Monday.
A judge denied the defense team's request for a new trial on Thursday, Oct. 17.
Whitney Ard, 31, was arrested in 2022 after an investigation into her 2-year-old son Mitchell Robinson's death. Arrest documents said a toxicology report showed 14 ng/mL of fentanyl in the child’s blood.
Robinson was pronounced dead after being brought to the hospital in June 2022. Investigators learned that he had previously been brought to the hospital two other times in the same year.
According to an affidavit, a sibling of Robinson said he “ate mom’s pills.”
Ard was arrested and initially charged with negligent homicide. She turned down a plea deal for a charge of manslaughter for a 30-year sentence in April of this year. She was found guilty of murder in September.
After Robinson’s death, the Louisiana Department of Children and Family Services changed its policy to increase the priority response level of cases involving children and drugs.
