San Diego is paying out more than $630,000 to settle cases involving a flooded house in University Heights and damaged sidewalks in University City and just east of downtown. The City Council approved one of the payouts Tuesday and three of the payouts Oct. 8. The largest payout of $300,000 goes to Jeffrey Allen Welsh and Christina Anne Flynn, a married couple whose home on Adams Avenue just west of Texas Street was flooded multiple times because of failing city stormwater infrastructure. In a lawsuit, the couple said heavy rains caused severe flooding on nearly a dozen occasions between fall 2019 and fall 2021 when an overflowing city catch basin in front of their house sent water over the curb. The suit says the flooding damaged drywall and items in the basement, while also creating a sinkhole and displacing massive amounts of soil. After the floods, cabinets and doors in the house no longer lined up, the suit says. The couple estimated the damages at more than $1 million. The settlement eliminated the need for a civil trial that had been scheduled for Sept. 6. The city is paying out $145,000 to Lillian Smith, who sued after she said she tripped and fell on a raised concrete sidewalk on Imperial Avenue near 31st Street in Grant Hill in June 2022. Her suit says the sidewalk had been asphalt patched, contending that created the dangerous situation. The payout covers lost wages, decreased earning potential and medical expenses. A trial had been scheduled for Nov. 8. The city is also paying out $85,000 to Laura Ann Brickley, who tripped and fell in a hole while walking downhill on a sidewalk on Regents Road near Pennant Way. A suit filed by Brickley blames the October 2022 incident on the sidewalk having gaps between asphalt areas that were covered in dirt. The payout covers lost wages, decreased earning potential and medical expenses. A trial had been scheduled for January. A fourth payout of $104,000 goes to Flatiron West, which had filed a claim — a precursor to a lawsuit — alleging it suffered property damage at its Linda Vista site due to flooding when a water line connected to a fire hydrant failed.
