Rochester, N.Y. (WROC-TV) — Among the yard signs sporting the names of various candidates are a few telling folks to vote for or against “Prop 1”. That proposition is on this year's ballot and would expand the Equal Rights Amendment within New York State's constitution. Right now, the amendment prohibits discrimination based on “race, color, creed, or religion.” Prop 1 would add ethnicity, national origin, age, disability, sex, including sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy. Supporters of Prop 1 say this expansion eliminates any potential loopholes that might currently exist and ensures more protection for more people. Sasha Ahuja, campaign director for New Yorkers for Equal Rights, sees the measure as an additional safeguard for abortion rights on top of current state law. “If Roe v. Wade has taught us anything, it's the laws can be changed at any time so we need to make sure that here in New York, our rights and our freedoms including the right to abortion aren't left up to politicians to play political football with,” Ahuja said. Opponents, however, claim the measure could pave the way for more transgender girls to play more girls sports in high school, a proposal that is currently being considered by the NYS Board of Regents. One anti-Prop 1 group, The Coalition to Protect Kids-NY, also alleges the measure is designed to exclude parents in their children's decision, should they make it, to receive transgender medical interventions and other gender-affirming care. NYS Senate Republican Leader Rob Ortt sent News 8 this statement: ​​"Proposition 1 is a radical attack on the rights of women and girls, especially in sports. New York Democrats are using this measure to push an extreme agenda that undermines fairness and common sense, and strips parents of their rights. We need every voter to step up, get to the polls, and protect the future of girls' sports and parental rights by voting against Proposition 1." Ahuja call this misinformation. “Parents will continue with Prop 1 to be involved every step of the way in health care decisions for their kids,” she said. “On the issue of trans kids and sports … (Prop 1) does not change existing law when it comes to young people and sports teams. In fact, this works hand in hand with Title IX.” Notably absent from the proposition is the word “abortion.” While that may cause concern among some in the pro-choice crowd, Ahuja assures them the measure would codify the right to have an abortion.
