MEMPHIS, Tenn. -- Another store owner is facing charges after authorities say he ran an illegal gambling operation at his business in Berclair.  This comes months after the Shelby County District Attorney said his office is cracking down on illegal gambling.  The gaming machines at Smile Mart on Waring Road had all been disabled by the Memphis Police Department's Organized Crime Unit for illegal gambling. The owner, 50-year-old Habtamu Moges, is charged with gambling promotion and possession of a gambling device or record.  Mid-South businesses put on alert about illegal gaming machines Court records say they executed a search warrant at the businesses Thursday afternoon after an under detective gambled on the machines, won money, and was able to cash out their winnings at the register.  MPD says Moges made the cashout.  Police say they seized over $1400 within the machines and several cash-out vouchers. WREG spoke to an employee who said they were told the machines were legal and had seen them at other locations in the city. A decal in the top left-hand corner of the machine reads "State of Tennessee Coin-Operated Amusement Tax." According to the Tennessee Department of Revenue website, the tax is levied on "bona fide coin-operated amusement machines" which are machines or devices that will automatically provide music or some other type of entertainment when a coin, token, or some other object, such as a credit card, is deposited into them. LIV Golf season in review: Rahm, Ripper GC hold the trophies Man charged with having illegal gaming machines in store Back in July, Shelby County District Attorney Steve Mulroy made it clear that any machine you have to put money in to potentially profit from is illegal in Tennessee. Mulroy acknowledged that the machines are becoming increasingly common in stores but said that does not change the law. "It creates an atmosphere of permissiveness for other types of illegal activities, you know you have drug sales going on, you have fights over the proceeds, and that leads to that breeding ground of crime that we are worried about," Mulroy said. This is also Moges second gambling search warrant at this location, according to reports. The first time he was given a misdemeanor citation.  Habtamu Moges is due in court on Monday morning.
