NARRAGANSETT, R.I. (WPRI) — Property owners suing the town of Narragansett over a proposal to regulate short-term rentals got a win on Wednesday. A judge issued a temporary restraining order and preliminary injunction. WC-2024-0372-Decision-Filed_1728048593Download "I think the town wants to protect its residents and it wants an environment that's accessible and friendly to everyone," Stephen Lapatin, attorney for a group of property owners called Naragansett 2100, told 12 News. "And we understand that. The town could certainly regulate things like short-term rentals, but it can't do it in this way." The lawsuit was filed by the group over the summer. "The Rhode Island Supreme Court has interpreted this amendment as not allowing cities and towns to license," Lapatin added. "It's our position that the short-term rental ordinance is a licensing ordinance. Because of that, the town cannot license short-term rentals." Narragansett Town Council President Ewa Dzwierzynski told 12 News the council is "disappointed with the decision," but couldn't comment further since it "involves active litigation."
