BAKERSFIELD, Calif. (KGET) -- A 37-year-old man accused of approaching a minor inside a Beach Park bathroom has been charged with three misdemeanor counts, according to court records. A video of the man engaged in a sex act with an adult in the public restroom was found on his phone, reports say. Andres Eubanks faces charges of annoying or molesting a juvenile, loitering around a public restroom with the intent of engaging in lewd acts and driving on a suspended or revoked license, records show. Man arraigned on murder charge in McFarland fatal shooting He was arraigned last month and his next court hearing is set for Oct. 11. Eubanks has a prior conviction for engaging in lewd conduct in a public place, police reports say. On Aug. 26, the alleged victim told police he was using the urinal inside the Beach Park bathroom when a man walked up and "reached around him while holding a cellphone in his hand," according to the reports filed in Superior Court. The juvenile said he wasn't sure if the man took a photo. He left and told his father what happened. The father told police he entered the bathroom to confront the man and saw him watching "pornographic material", according to the reports. He said the man left, got in a vehicle -- a Toyota Rav4 -- and drove away. Never miss a story: Make KGET.com your homepage Police received word the suspect had gone to Yokuts Park. They arrived and detained Eubanks. The alleged victim was taken to the park and identified Eubanks as the man who approached him, the court filings say. Eubanks told police he believed he'd been drugged. He said he had trouble remembering what happened that day, according to the reports, and he'd left Beach Park because someone confronted him and he didn't want trouble. Police examined his phone. There was a video taken earlier that day of Eubanks performing a sex act on another man inside the Beach Park bathroom, according to the reports. Eubanks' phone was seized and he was arrested.
