This election day, November 5, 2024, Idaho will be voting to potentially amend its state constitution. The amendment, which would make it illegal for non-citizens to vote broadly in any Idaho election, would add a second line to Idaho’s constitution that criminalizes the act. CBS2 reports no state in the U.S. currently allows non-citizens to vote in elections, and non-citizen voting has been federally illegal since the 1996 passage of the Illegal Immigration Reform and Immigrant Responsibility Act. There are no states in the United States which allows non-citizens to vote in state or federal elections. Eight states, including Idaho, have constitutional amendments on their 2024 ballots that would include the additional language. Since 2004, the Heritage Foundation has tracked voter fraud instances nationally and has found no cases of a non-citizen attempting to vote in Idaho since they began keeping track.
