ALBUQUERQUE, N.M. (KRQE) – A New Mexico woman who was raped by her arresting officer will now be getting a hefty payout from the state of New Mexico. KRQE Investigates first reported on what the former Isleta police officer admitted to years ago after he arrested the woman. Today, another court battle in the case has come to a close. One fateful night in November 2021 led to the arrest of Isleta Pueblo police officer, Leon Martin. His 21-year-old DWI suspect at the time, accused him of raping her. Today, that woman's lawsuit against the now-former officer Leon Martin and the State of New Mexico was settled for $1.5 million. The settlement stipulates, "Neither the State nor any of its agencies or present or former officers or employees admits any negligence, wrongdoing and/or liability to the Plaintiff…" The settlement also states New Mexico's Risk Management Division on behalf of the State settled the lawsuit solely to "avoid the time, energy, and expense of litigation." READ: Full Lawsuit For his part, Martin admitted to an investigator with the New Mexico State Police in a recorded interview that he drove the woman to a remote area near the Metro Detention Center in Albuquerque when he should have taken her to jail in Valencia County. "To be honest, we did have sex but it wasn't for long," Martin told the State Police investigator. However, the woman claimed he knew what he was doing and told her to stay quiet about it. The lawsuit against him states. "Martin turned off his radio and location data so that his whereabouts were undetected." "I mean you're f****** going west, and you should be going south," the State Police investigator told Martin in a recorded interview obtained by KRQE News 13. "That's a huge difference. Is that what happened? You just took her up there because you knew it was a secluded spot?" Martin replied, "Uh, not. Yeah, but nah." "You obviously were wanting to have sex with her," the investigator added. "If you didn't want to have sex with her, you wouldn't have had sex with her. Right?" "Yeah, well, she said that she did want to talk, and that's when it did escalate," Martin answered. Because the woman spoke up, first in a phone call from jail to her father, and later to authorities, Martin was arrested and eventually convicted by a jury for rape. "He told me not to say anything and I haven't showered," a recorded phone call from jail obtained by KRQE reveals what the woman reported to her father shortly after her arrest. "And whenever I get out tomorrow, I want to go straight to the hospital." Now stripped of his badge and spending time in prison, another chapter in Martin's victim's case is over, as the State of New Mexico pays up. "I could have prevented it," Martin told the State Police investigator during his recorded interview. "I should have prevented it. But, it just, it escalated too far to what I wanted it to." Martin was sentenced to four years in prison, plus two years on probation once he's released. He will also have to register as a sex offender for life.
