MUNCIE, Ind. — A Muncie man faces multiple preliminary charges after police said he fired shots at an apartment complex, a mere 0.6 miles from Ball State University's campus. According to the Muncie Police Department, officers were called around 6:09 a.m. on Sept. 28 to the 800 block of W. Riverside Ave., on the report of shots fired. Upon speaking with callers and subjects on-scene, police identified 22-year-old Trevon Embry as the individual responsible for the gunfire. Trevon Embry (MPD) According to MPD, Embry was armed with a "Draco" rifle and was shooting at a number of people. Police said these people went to Embry's residence, believing there to be a woman there, and were concerned for her safety. When those subjects arrived, they were told by a different woman that Embry was not home, police said. That's when the subjects entered Embry's residence to find he actually was inside. Reportedly, Embry then went to another room, retrieved a rifle, cocked it and told everyone inside to "get out". Police said the subjects agreed to leave but once they were outside, Embry fired his rifle at them six to seven times. Officers then located eight spent shell casings in Embry's driveway, as well as one live round inside his residence. Per MPD, they also found an empty box and receipt for the Draco rifle, but the actual location of the gun could not be found. Officers later discovered that Embry was on probation for the time. This stems from a 2020 shooting that Embry was involved with in which he pleaded by agreement to residential entry breaking and entering (Level 6 Felony) and battery resulting in bodily injury (Class A Misdemeanor). According to publicly-available online court documents, Embry received a probation sentence of one year on Aug. 2, 2024. He was also arrested in June in connection to a shooting at a Muncie party. Now, Embry faces the following preliminary charges: Attempted murder (Level 1 Felony) Criminal recklessness (Level 5 Felony) Intimidation with a deadly weapon (Level 5 Felony) Pointing a firearm (Level 6 Felony) Obstruction of justice (Level 6 Felony) The Delaware County Prosecutor's Office will decide the next steps and whether to file formal charges against Embry. As of this article's publication, no official charges have been filed.
