PORTSMOUTH, Va. (WAVY) — A local dog owner is looking for answers after someone shot his dog Jack last Friday.  Tim Tierney was in his front yard on Channing Avenue and Harris Road letting his dog, a three-year-old pitbull-lab mix, get all his extra energy out.  Tierney was tossing Jack’s favorite ball on the lawn at midnight in the Cradock area of Portsmouth when he saw the man, tall, skinny and in his early 20s, walking down Harris Road around midnight when the dog ran across the street. “The dog ran out in the street to say hi to him, and get attention," Tierney said. "He was in a submissive stance at his feet." Tierney called for Jack twice and let the man know that he was outside with his dog. He said the man hears and makes eye contact with him.  “I kept moving, and by the time I got to right here, he pulled the gun out, pointed it straight down, and just shot him point blank, and then ran up the street,” Tierney said.   In the video captured, you see the man run down Harris Road. Tierney initially took off after him, but then went to look for Jack.  He returned to find Jack, now in the grass of his neighbor's lawn. The neighbors hear the gunshots and Jack’s yelps and call the police. The police showed up, but Tierney was getting ready to take Jack to the pet emergency room.   Tierney took Jack to Indian River Veterinary Hospital, where he started to bleed through his nose and started to cough up blood.  “They did an X-ray, and they found that the bullet had hit his lung, and there was blood going into his lung,” Tierney said.  Tierney told 10 On Your Side that they would not be able to perform the surgery until Saturday afternoon, and that Jack did not have a high chance of making it to that time. Tierney said he had to make the difficult decision to put Jack to sleep.  The owner said he is heartbroken.  “He's just as much as my kid as a two-legged kid, is, and he was an awesome dog," Tierney said. "And nothing feels right." The suspect is still on the loose. Tierney said even off the leash, his dog was not aggressive towards the man.  "You then pulled the weapon out — that's not fear, that's not protecting yourself," Tierney said. "That's doing it out of spite, because you can, and you think it's funny, and that's what's wrong with this world these days." 10 On Your Side spoke with Portsmouth Animal Control on the phone. It said that if the dog is attacking you, you are in the right to defend yourself, but it's on a case-by-case basis.  Both Animal Control and the Portsmouth Police Department are involved in the case.  “It would be nice if the person that did it gets caught," Tierney said. "It was pointless. There was no reason."  Animal Control spoke with Tierney Wednesday. It is looking to find more information on the suspect.
