GRANDVIEW, Mo. - A dog owner is recovering from an attack at a Grandview park. Charles Shupert, 75, says he initially feared being attacked by a dog but ended up being attacked by the dog's owner. Shupert takes his Lhasa Apso, Winston, to nearby John Anderson Park for a walk about every day. On Monday, September 23, he says an owner arrived in a white pickup and let a large dog he believes to have been a pit bull out of the truck. The dog wasn't on a leash, but the owner was carrying it in her hand according to Shupert. The 75-year-old says he or Winston have been attacked by dogs off leash at the park where signs state owners must follow leash laws four times before. He says he was uncertain of the dog's next action when he went running toward him and Winston. "Being as big as it was and muscular as it was and as loose as it was, I didn't know," he said. Shupert carries a stun gun and mace. According to Shupert, he grabbed the first thing he found in his pocket and proceeded to spray pepper gel in the area of the other dog's feet. "He was looking down at Winston and I sprayed just a little bit and the dog was okay," he said. KC man accused of using stolen credit cards to buy gift cards across the metro However, the woman with the dog wasn't okay with Shupert's use of pepper gel. "She was out of her mind, saying what did you do to my dog?" he described. Shupert said he tried to de-escalate the situation and turned to walk away. That's when he says she used the leash the dog wasn't on as a weapon. "It had a heavy metal thing on the end of it and she hit me on the back of the head with it and I went down," he said. Shupert was bloodied from ear to ear leading him to believe she struck him multiple times. More than a week after the incident, he still has a black eye. "This side could have took out my eye because this was a lot worse," he pointed out. The dog owner left the leash behind which Shupert turned over to Grandview Police who are investigating. Shupert says his ultimate concern isn't with the attack, but what led up to it. "Please put it on a leash, keep your dog under control," he urged other dog owners. Download the FOX4 News app on iPhone and Android According to Grandview ordinances, dogs are required to be either on a leash or behind a fully enclosed fenced area. Fines for violating animal control ordinances range from $50 to $500. Shupert says he and neighbors plan to attend a Grandview Parks and Recreation Board meeting Thursday at 6 p.m. and an upcoming Grandview Board of Alderman meeting to voice their concerns at about Grandview leash laws not being followed.
