(KRON) – AHMC Healthcare, owner of Seton Medical Center and Seton Coastside, is being sued for allegedly not following an agreement given to them upon purchasing the hospitals in 2020, California Attorney General Rob Bonta announced on Wednesday. According to the DOJ, Seton Medical Center in Daly City is currently missing a center for stroke and heart attack patients, among other things. Seton Coastside in Moss Beach suspended its emergency services since April. Despite their disappearance, Bonta claims these centers, as well as others, were legally required to stay open.  “Unfortunately, AHMC clearly has not upheld its obligations. This failure to meet the required standards is completely unacceptable, and I’m holding them fully accountable for placing patient care and public health at risk,” Bonta said.  Will the Port of Oakland be impacted by port strikes on the East Coast? California law requires the sale and transfer of control of a nonprofit to have the consent of the Attorney General. Despite agreeing to the sale, Bonta alleges AHMC violated the conditions that were set in place four years prior to this lawsuit.  AHMC Healthcare bought the two Bay Area hospitals from the bankrupt Veruty Health Care in 2020. Part of the deal was to keep Seton Coastside – which includes an emergency department and skilled nursing facility – open until December 2025. The sale was approved by Bonta. Here are some of the other conditions set forth for both hospitals, according to Bonta’s office: Emergency department (ED) at both hospitals Stroke center certification  STEMI receiving center (for heart attack patients) General acute care hospital (GACH) Skilled nursing facilities (SNF) According to Bonta, “AHMC has permitted the stroke certification and STEMI designation to lapse at Seton Medical Center and has closed the SNF, GACH, and ED at Seton Coastside since April 2024.”  Bonta alleges that AHMC did so “without notifying nor seeking an amendment of the conditions from the Attorney General.” If closed, the lawsuit alleges that the reduction in services can have negative consequences, such as requiring people to travel farther to reach the appropriate care. Seton Coastside is the only facility providing emergency services for 55-miles along the Pacific Coastline from Santa Cruz to Daly City and is a lifeline for patients in need of emergency care. I am deeply concerned about the impact the emergency department’s closure will have on access to emergency medical care and with the lack of transparency afforded to local representatives who want to protect our shared constituents’ access to critical health care services Congresswoman Anna G. Eshoo Seton-ComplaintDownload Bonta believes the suspension of these services also increases patient volumes at hospitals that offer those services, which also escalates the rates for services at those competing hospitals.  The lawsuit is seeking a “crucial” reopening of services at both hospitals, as well as civil penalties. "I implore Seton to right the ship immediately for the health and safety of its patients, some of the most underserved in San Mateo County.” San Mateo County Board of Supervisors Vice President David J. Canepa said.
