WOODBURN, Ind. (WANE) -- A Defiance, Ohio, man is facing a felony charge after he reportedly had alcohol and THC in his system during a crash that left his passenger with serious injuries, according to Allen Superior Court documents. The suspect, identified as 41-year-old Loyd Burton Keener Jr., was in a crash March 8 just outside Woodburn that resulted in his vehicle rolling over and leaving him trapped. A passenger also said in court documents Keener was unresponsive and "blacked out" while driving, according to court documents. The passenger suffered four broken lumbar discs and four fractured vertebrae in the crash. An officer with the Woodburn Police Department responded to the crash and reportedly noticed a "faint" smell of marijuana coming from the vehicle, according to court documents. Keener reportedly told police there was marijuana and a smoking pipe in the car, but police could not recover the items due to the crash. A chemical test at Parkview Regional Medical Center the night of the crash reportedly showed Keener had THC in his system During an interview with police the night of the crash, Keener said he had a medical marijuana card for a pinched nerve and had taken 1,000 milligrams of marijuana roughly two hours before the crash happened and had been told not to drive for one hour to 90 minutes after smoking, according to court documents. Keener also reportedly told police he had taken two shots of moonshine more than three hours before the crash. Keener faces a Level 5 felony charge of causing serious bodily injury while operating a vehicle with a Schedule I or II substance. An initial hearing in court has not yet been scheduled.
