NEW ORLEANS (WGNO) — After a nearly 8-year legal battle, St. Charles Surgical Hospital and Center for Restorative Breast Surgery has won a massive lawsuit against health insurance giant, Blue Cross Blue Shield. The company is now forced to hand over $421 million for years of fraud and abuse of rights. "Blue Cross tried to pretty much use any type of delay tactic they could to avoid having this trial in Orleans Parish, state court, which is where we ultimately tried the case," Attorney Matthew Sherman said. Judge overseeing case for former New Orleans priest recuses himself, trial delayed After a 3-week trial and less than 2 hours of deliberations, the jury unanimously ruled in the centers favor. The trial unveiled Blue Cross acted fraudulently by authorizing more than 7,000 surgeries but only paying about 9% of the cost. "Our hospital in the center ensured that before any services were done, that they had the claims authorized. And despite all of that, Blue cross either no paid, low paid or slow paid each and every claim," Sherman said. Dr. Frank DellaCroce is a world renowned plastic surgeon, bringing in thousands of patients from out of state. "To have a woman come to my clinic the day before her surgery and tell me that she's been called by a nurse navigator to tell her that there are other surgeons in the community that they might deem as being more affordable, yet maybe without as much expertise. They come in with tears over that, that added stress in a moment of crisis is unacceptable to me." WGNO News reached out to Blue Cross Blue Shield who said in a statement, "While we appreciate and value the legal process, we strongly disagree with the jury's verdict. "It's been a long 7 and a half years, but they never wavered from their position. They knew if we could get this case to trial, that that they were in the right. It's overwhelming to know that the jury unanimously believed that blue cross blue shield committed fraud and abuse their rights."
