ALLEN COUNTY, Ind. (WANE) - A driver now faces charges in a head-on crash from almost a year ago that sent a horse running away from its buggy, ultimately causing a second crash. Allen County prosecutors filed charges Thursday for James J. Brown, 65, who faces a Level 5 felony count of operating a vehicle while intoxicated causing serious bodily injury, a Level 6 felony count of criminal recklessness, and two misdemeanor counts of criminal mischief. On Nov. 12, 2023, Brown was driving a Jeep that crashed into a buggy on State Road 37 at Cuba Road around 6:30 p.m. The horse ran from the scene, and the force of the collision sent the buggy 20 feet away from the Jeep. According to Allen Superior Court documents, Brown claimed he was following another car that drove into the opposite lane to get around the buggy, but his own maneuver was not successful. "Brown said the next thing he knew, he had hit the buggy," police wrote in court documents. Police find stolen gun, fentanyl and over 2 lbs of crystal meth in raid of Fort Wayne homes But a witness told police they didn't see a car in front of Brown, who was "driving all over the roadway," according to court documents. The witness said they were about to call 911 to report reckless driving when they saw Brown crash into the buggy. Brown told officers at the scene he'd had two shots of vodka, two shots of something else, and another drink but he couldn't remember, according to court documents. Brown even admitted to police, "he should not have been drinking and driving and he knew what he did was wrong," according to court documents. Meanwhile, the horse that got loose ended up further down SR 37 and went in the middle of the road. The driver of a minivan said she couldn't stop in time and hit the horse before also hitting a tree, according to court documents. The horse died at the scene. Police went to a hospital to speak with the man who'd been operating the buggy. The man had serious injuries from the crash, including what's described in court documents as "a laceration to his scalp that required staples to close" among other injuries. There were four passengers in the buggy who had minor injuries, according to court documents. A warrant has been issued for Brown's arrest.
