FAIRFAX COUNTY, Va. (DC News Now) -- Fairfax County prosecutors and defense lawyers are preparing for more testimonies in the case of a former police sergeant on trial for the deadly shooting of an unarmed suspected shoplifter in Tysons last year. Former Sgt. Wesley Shifflett is accused of involuntary manslaughter in the deadly shooting of Timothy Johnson that occurred on Feb. 22, 2023. PREVIOUS COVERAGE: Police shoot, kill man near Tysons Corner Center Johnson was shot after allegedly running away from officers after stealing sunglasses from Tyson’s Corner Center. Shifflett's defense in this case told the jury during opening arguments Wednesday to look at this case through his eyes, saying he had only seconds or even milliseconds to decide whether to shoot. Both sides said in court that Johnson had tried to steal sunglasses from Nordstrom when store employees noticed him and reported him to police who were stationed in the mall. Much of Wednesday's witness testimony centered around the first moments of Johnson's interactions with Nordstrom store employees. Prosecutors played video in court showing Johnson wandering around and looking at sunglasses, before taking at least two pairs, and later returning glasses to a store associate. Shifflett was part of the Tysons Urban Team, responding mostly to incidents of theft and other incidents in and around the shopping district. They said he walked out before eventually starting to run with officers trailing behind him shortly after he exited the mall. Both defense lawyers and prosecutors said Johnson ran through garages and parking lots before heading into a wooded area near the mall, followed by Shifflett and another officer who told him to get on the ground. The defense describes what happened next as the "scariest moment of the sergeant’s life," saying Johnson seemingly tripped and tumbled to the ground, rolled onto his knees and reached into his waistband as if to pull out a weapon. That’s when Shifflett decided to fire twice, with one of those bullets hitting Johnson in the chest. The second officer wasn’t far away. The defense said he saw both Shifflett and Johnson on the ground. That officer fired a third shot, not hitting either of them. Johnson did not have a gun on him. The defense said sunglasses were found near Johnson. He later died of a gunshot wound. Manassas man wanted for murder of teen arrested in Massachusetts The defense said Shifflett only did what he was trained to do as a Fairfax County Police Department officer of seven years. His lawyers said he tried to tell Johnson to "get down" and "stop reaching," before veering to the right and firing those two shots. Additional testimony is expected to continue Thursday morning. Prosecutors and defense lawyers suggested the court would hear from more officers on the scene that night.
