HAMPTON COUNTY, S.C. (WSAV) - The Judge in the latest civil lawsuit involving Mallory Beach's family is being asked to step away from the case. Lawyers for the Beach family filed a motion requesting Judge G.D. Morgan Jr. recuse himself from the case. FILE_5242Download This comes after the Judge hired a law clerk, Adam Compton, who previously worked for the attorney representing Parkers, the defendant in this case. Beach's lawyers, Mark Tinsley, John Nichols and Tabor Vaux, say Judge Morgan hiring the clerk "creates an appearance of impropriety" and could be a conflict in the case. "There has never been a more important time for Judges in this state to "act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary" the filing states. "Our clients do not feel comfortable and have entertained Your Honor's invitation for Your Honor to be recused." This suit filed in Hampton County court, claims Parkers conspired with a documentary journalist and private investigators to leak autopsy photos and other records and "inflect emotional distress" on the family. Beach died on February 24, 2019, when a boat driven by Paul Murdaugh, in which she was a passenger, crashed into the Archer's Creek Bridge near Parris Island. This is the second lawsuit filed by the Beach family against the convenience store chain. A Parker's clerk was caught on video selling alcohol to Murdaugh's underage son, Paul, hours before the late-night Beaufort County crash that killed Beach. In July 2023, Parker's Kitchen agreed to pay $15 million to settle that wrongful death case. The judge "did" tell both sides about the clerk's hiring last month and told attorneys if they had an issue or conflict to bring it up. Parker's attorney has requested an extension to respond to the recusal request. If granted, the response would have to be submitted by Sept. 30. Judge Morgan has not commented on the filing.
