Sentencing draws near for 19yearold accused of double shooting at George Wythe High School

RICHMOND, Va. (WRIC) — A Richmond man’s sentencing draws near after being found guilty this past February for a double shooting outside of George Wythe High School injuring two teen boys in April of 2023.
David Gutierrez, 19, will face a judge in Richmond City Circuit Court for a pre-sentencing report hearing.
A pre-sentencing report complies all history of a defendant—including criminal, personal, educational, employment, health, etc.—allowing the court to provide appropriate and fair sentences.
A four-day jury trial ended with a guilty verdict for Gutierrez on the following charges:
Unlawful wounding
Malicious wounding
Using a firearm while committing a felony
Possession of a firearm on school property.

The charges stem from the incident on Thursday, April 27, 2023 outside of George Wythe High School.
Richmond Police officers arrived at the school around noon to find the first victim, who was a boy with life-threatening injuries in a wooded area by the parking lot. Authorities confirmed, that the other victim, also a boy, took himself to the hospital to be treated for non-life-threatening injuries.
Both victims were students of the high school and Gutierrez was also a student at the school.
Defense attorney’s, some witnesses and Gutierrez himself noting the act was out of defense for one of Gutierrez’s friends who was being bullied by a group of teens who they've had issues with in the past.

The prosecution suggested otherwise, stating there was no clear evidence of bullying, and that Gutierrez knew there would be a fight that day and that he planned to have a gun and two baseball bats in the back of his car at the time.
Prosecutors also questioned the claim of Gutierrez dropping his friend at school when he parked behind the school.
The pre-sentencing report hearing is scheduled for 1 p.m. on Monday, Sept. 16.
