PINEVILLE, N.C. – The bottom line from the Mecklenburg County District Attorney: a jury won’t unanimously agree a Pineville Police officer committed a crime when he shot and killed suspected shoplifter Dennis Bodden. But the officer’s tactics raise questions. In a 20 page letter, DA Spencer Merriweather lays out what happened in Pineville on May 14th. Some of the major findings include that Sergeant Adam Roberts told dispatch that Bodden had tried to “push off on him.” Merriweather says body cam video shows there was no contact between Roberts and Bodden up to that point. The body cam video also shows Bodden’s hands were visible empty. Merriweather says immediately after the shooting, Charlotte-Mecklenburg Police investigators asked Pineville Police to not allow the two officers on the scene to review their body cam videos. Investigators wanted to be sure that the officer’s explanations would come only from their memory of what happened, and not influenced by the videos. Pineville Police said no, and that they would allow the cop to see their videos. Sgt. Roberts chose not to view his body cam video before being interviewed by investigators. Merriweather says Roberts told investigators that he pulled his gun because he couldn’t tell if Bodden had grabbed the second officer’s taser. Roberts says Bodden then tried to grab his gun. and that’s when the officer fired. “There is no excuse for this,” says Corine Mack. Mack is the president of the Charlotte NAACP. She continues, “(Bodden) was fearing for his life and fighting for his life, but he had no weapons. And so I need to understand what level of harm was this man bringing to these officers, plural, when he had no weapon?” Bodden’s mother spoke with WCCB News @ Ten anchor Morgan Fogarty about Merriweather’s findings. Cleopatra Bodden said, in part, “My son was an unarmed, Black attorney who was gunned down by a trigger-happy, rogue Pineville Police officer.” The second officer on the scene, Officer Randall Down, not only viewed his own body cam video (again, against the advice of CMPD and the DA), but also the body cam video from Sgt. Roberts. Officer Down told investigators that he didn’t pull out his own gun because he didn’t think Bodden’s behavior was “at the level of deadly force.” Pineville Police sent WCCB a statement, saying in part, “We support and respect the rigorous due process involved in situations such as this…Pineville Police will always be transparent and forthcoming…Our deepest condolences continue to be extended towards the entire Bodden family during this extremely difficult time.”
