CHICOPEE, Mass. (WWLP) - A judge has declared a mistrial in the Karen Read case today after the jury could not reach an unanimous verdict. 22News spoke with another local lawyer who is weighing in on what this exactly means. After days of deliberation a mistrial has been declared in the Karen Read case…the jury in a deadlock Monday afternoon. Teenager arrested after two injured in Pittsfield shooting Judge Beverly Canonne of Norfolk Superior Court said, "to continue to deliberate would be futile and only serve to force us to compromise these deeply held beliefs." A mistrial is a trial that is not completed and that can happen for a variety of reasons, whether an error, misconduct, or in this case, when a jury cant come to a verdict, also known as a hung jury. Read was facing second degree murder charges in connection with the death of her boyfriend, Boston Police Officer John O'Keefe. She remains a free woman for now, but in a statement to 22News' NBC affiliate in Boston, the Norfolk District Attorney's Office says that they do intend to retry the case. State law requires the retrial to begin within one year. "There's going to be a significant challenge of course," explained Lawyer James B. Winston from the James B. Winston Law Offices in Northampton, "To select a jury pool to find people in this county that haven't already either made up their mind or been absorbed with this trial." A status conference for the case is scheduled for July 22nd in Norfolk Superior Court. In the meantime the former lead investigator of the case, Trooper Michael Proctor has been relieved of duty from the Massachusetts State Police following the news of the mistrial. Proctor is facing an internal investigation for what the department is calling 'serious misconduct' that emerged in testimony at the trial.
