DINWIDDIE COUNTY, Va. (WRIC) -- The family of Irvo Otieno, who died at Central State Hospital, along with their attorney, addressed a judge's approval to drop the charges against of five out of eight sheriff deputies charged in his death during a press conference Monday morning. The press conference was held at 11 a.m. on Monday, May 6 at The Krudys Law Firm, PLC. Dinwiddie County Commonwealth’s Attorney Amanda Mann confirmed that nolle prosequi — or “unwilling to prosecute” — motions were filed on Friday, May 3 for the five deputies charged; Randy Boyer, Dwayne Bramble, Jermaine Branch, Bradley Disse and Tabitha Levere. The request to withdraw second-degree murder charges for those five deputies was then approved by a judge on Monday, May 6. On March 6, 2023, Otieno was being transferred from Henrico County Regional Jail West to Central State Hospital. Virginia State Police — the agency leading the investigation into Otieno’s death — says as deputies were admitting him as a patient, he became combative during the intake process. 8News obtained security camera video showing the moments leading up to Otieno’s death. Deputies and hospital staff can be seen restraining him before he is given aid by staff members and EMS responders — after which he was pronounced dead. Mark Krudys, the family's attorney responded to the decision of the judge to drop the charges during the press conference. "Nolle prosequi means that [the commonwealth's attorney] can bring these cases back, but it is an agonizing wait. We were going to begin less than a month from now, and now we have to begin in the fall," Krudys said. Further, the family and their attorney urged the involvement of the Department of Justice to assist in the case. "This prosecution needs to start moving forward. We renew our call for federal prosecutors to be involved in this matter, coextensive with the local prosecutor," Krudys said. Otieno's mother echoed Krudy's sentiment, saying, in part, "The [Department of Justice] where are you? It is time for you to bring your boots to Richmond and get justice for my son."
