The Wheat Ridge Police Department won’t recommend criminal charges in the fatal Interstate 70 crash that left three people dead and three injured on Aug. 15. Its investigation, which spanned over a month, was closed on Wednesday after the First Judicial District Attorney’s Office of Colorado and police determined that no crime occurred. The accident on eastbound I-70 near Ward Road involved four vehicles. It occurred along a stretch where workers were replacing a bridge as part of a $16.4 million project that’s slated for completion next month. The unnamed truck driver, the couple’s baby, Daniel Rodriguez Plata, and Plata’s father, Carlos Joaquin Plata, sustained injuries. Passengers riding in the other affected vehicles declined medical care. The accident has triggered a review by the Colorado Department of Transportation of whether to reduce the work zone’s speed limit. The police investigation included reviewing data about the truck’s speed, which was moving 59 miles per hour in a 60-mph zone, and a recent truck inspection that yielded no issues. Information collected about 40 minutes before the crash at the Colorado State Patrol Port of Entry weigh station put the truck at around 8,000 pounds underweight, with no brake problems. The driver wasn’t impaired or intoxicated, according to police. The victims’s family was first informed before the news was made public. “This was a tragic, heartbreaking accident and we want to give this family our full support,” the Wheat Ridge Police Department wrote in a Facebook post.
